  2.      JP SOFTWARE PRE-RELEASE LICENSE AGREEMENT AND LIMITED WARRANTY
  3.  
  4. (1) Introduction.  This agreement explains when and how you may use your
  5. pre-release copies of JP Software products.
  6.  
  7.      *  "Software" or "Pre-Release Software" means the JP Software
  8.         software pre-release products(s) you have obtained for
  9.         evaluation, including both the software and the associated
  10.         documentation and other materials;
  11.  
  12.      *  "we" or "us" means JP Software Inc., a corporation based in
  13.         Arlington, Massachusetts, USA; and
  14.  
  15.      *  "you" means the end user of the Pre-Release Software.
  16.  
  17. (2) Legal Agreement.  This is a legal agreement which allows you, the
  18. end user, to use the Pre-Release Software under certain terms and
  19. conditions.  If you cannot agree to abide by what this agreement says
  20. you should destroy your copy of the Pre-Release Software.
  21.  
  22. (3) Copyright.  The Pre-Release Software is fully protected by copyright
  23. under U.S. law and international treaty provisions.
  24.  
  25. (4) Usage Period.  The Pre-Release Software may be used and tested up to
  26. the time stated in the signon message when the Software starts, or in
  27. other documentation which came with the Software.  After that time you
  28. must either cease using the Software, or purchase a copy.  THE SOFTWARE
  29. OR PORTIONS OF THE SOFTWARE MAY CEASE TO OPERATE OR MAY NO LONGER BE
  30. USEFUL AFTER THE TIME SHOWN IN THE SIGNON MESSAGE OR DOCUMENTATION.

  32. (5) Use of the Program.  While you are evaluating or testing the
  33. Pre-Release Software, you may use it on as many computers as are
  34. required to perform your evaluation and testing.  Once the evaluation
  35. and testing period is over and you purchase a released copy of the
  36. Software, your use of the released copy is limited to the number of
  37. machines for which you have purchased a license, as stated in our
  38. standard software license agreement distributed with purchased copies of
  39. our products.

  41. (6) Making and Distributing Copies of the Pre-Release Software.  You may
  42. make copies of the Pre-Release Software to give to others, as long as
  43. you include all of the files that you originally received with your
  44. copy.  When you give a copy of the Pre-Release Software to another
  45. person, you agree to inform them that the Pre-Release Software is only
  46. available for a time-limited evaluation period, that the Software may
  47. cease to function after that period is over, and that they must purchase
  48. a copy of the software in order to continue to use it once the
  49. evaluation and testing period has ended.  You agree not to sell
  50. Pre-Release Copies of the Program or distribute them to others for any
  51. kind of compensation or fee under any circumstances.

  53. (7) Operation of the Pre-Release Software.  The Pre-Release Software
  54. offers powerful capabilities.  If you do not follow our instructions, or
  55. if you use the Pre-Release Software improperly, you can destroy files or
  56. cause other damage to your software and data.  AS A PRE-RELEASE VERSION
  57. THE SOFTWARE MAY CONTAIN BUGS OR OTHER PROBLEMS WHICH WOULD BE LESS
  58. LIKELY IN A FINAL RELEASE VERSION.  You assume full responsibility for
  59. the selection and use of the Pre-Release Software to achieve your
  60. intended results.

  62. (8) WARRANTY STATEMENT:  THE PRE-RELEASE SOFTWARE IS PROVIDED "AS-IS"
  63. AND WITHOUT WARRANTY OF ANY KIND.
  64.  
  65. LIMITATION OF LIABILITY:  IN NO EVENT SHALL WE BE LIABLE FOR ANY
  66. INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES WHATSOEVER ARISING OUT OF
  67. USE OF THE PRE-RELEASE SOFTWARE OR YOUR RELATIONSHIP WITH US.  SOME
  68. JURISDICTIONS DO NOT ALLOW EXCLUSION OR LIMITATION OF LIABILITY FOR
  69. INCIDENTAL OR CONSEQUENTIAL DAMAGES, THEREFORE THE ABOVE LIMITATION MAY
  70. NOT APPLY TO YOU.
